MOEL Ordinance No. 393: revised training schedules and administrative procedures (Partial amendment to the Enforcement Rule of the Occupational Safety and Health Act)

This amendment reorganised regular training by half-year, widened the refresher-training window, and revised MSDS, asbestos and work-restriction procedures.

Half-year scheduling does not halve the annual training requirement

The general Annex 4 baseline became at least six hours per half-year for office and direct sales workers and twelve hours for other workers, replacing quarterly baselines of three and six hours. Supervisor training was placed in a separate category; its general baseline remains sixteen hours annually.

Check sector, size, exemptions and reductions separately. The period used for the relevant Article 27(2) training exemption was also changed from quarter to half-year.

Distinguish induction from refresher training

Induction categories distinguish daily workers and fixed-term contracts of up to one week (at least one hour), contracts longer than one week but up to one month (four hours), and other workers (eight hours). Special hazardous-task training has separate conditions.

For specified safety and health duty holders, the refresher window around each two-year anniversary after initial training widened from three months before/after to six months before/after. The two-year cycle itself did not change.

Check your workplace

  • Have workers been categorised by role and contract period?
  • Is the two-year anniversary and six-month window recorded?
  • Have the conditions for any exemption or MSDS linkage been checked?

MSDS linkage and asbestos procedures

Article 162(7) addresses reuse of approved substitute information by domestic or overseas manufacturers of another covered substance using the approved raw material and by importers of that product. Approval number and validity period must accompany it; production of a new chemical through changes in composition is excluded.

For qualifying new buildings with commencement notification on or after 1 July 2017, submitting the asbestos-survey omission application with a building-register copy can count as confirmation. This is not an automatic exemption without filing.

Reductions in reported asbestos material types or removal area by type were excluded from change notification.

Medical input and commencement dates

Before restricting work under Article 221(1) or (2), or returning a recovered worker previously restricted under those provisions, obtain the opinion of the specified medical professional. This is not a blanket rule for every return from sick leave.

Other changes cover consultant certificates, training-provider arrangements and MSDS appeal forms. Most changes took effect on 27 September 2023; consultant certificate provisions followed on 28 September.

Revised Annexes 4 and 5 apply to training after commencement. Use the current annexes and Article 27 for present-day planning because later amendments also apply.

Putting it into practice

Maintain a training register showing worker category, legal basis, half-year target, completed hours and remaining training. Check induction and special-task training separately before assigning new workers.

Technical insight

Separate training schedules from training needs

The half-year accounting period does not merge periodic, induction and task-specific training into one obligation. This amendment concerns South Korean requirements.

Link the training register to duties, contract duration and task changes. Keep professional refresher dates separate so aggregate hours do not obscure training needed before a new assignment.
