Amendment date is not effective date

The page for South Korea’s Rules on Occupational Safety and Health Standards lists promulgation on 2025-09-01 and effect on 2026-03-02. Record these as different fields.

Understand the situation

Promulgation records publication of a legal change; commencement specifies when it takes effect. They may differ.

“Recently amended” is not enough to decide which text applied on a work date.

Review the task

Record the relevant date, choose the corresponding edition and inspect supplemental provisions. Staged commencement or transitional arrangements may matter for a particular provision.

Check your workplace

  • What is the relevant work date?
  • Are there provision-specific dates?
  • Do history and attachments match?

Apply the lesson

The checked header of South Korea’s Rules on Occupational Safety and Health Standards distinguishes 1 September 2025 promulgation from 2 March 2026 effect. Ordinance 450 specifically delays the added sentence in article 241(2)(4) for six months.

A consolidated edition date is not the individual commencement date of every provision. Compare the header, actual text and supplemental provisions.

Avoid a common mistake

A revision register should identify affected articles, checklists and training materials. Review the English adaptation when Korean references change, without implying that foreign law changed at the same time.

Putting it into practice

Record check date, work date, title, enactment identifier, effective date, provision, transitional text and URL.

Technical insight

Track effective dates by provision

Publication and commencement may differ, and transitional clauses can apply to particular provisions or existing situations. One date at the top of a document may not describe every obligation.

Track the provision, commencement, applicability and preparation owner separately. Distinguish the law relevant to a historical event from the version needed for future work.

Check staged commencement and transitional provisions separately.
